Purpose of the policy

The purpose of this Privacy Policy is to describe the methods of management of the website: www.tfsoleodinamica.it for the sake of brevity hereinafter referred to as the “Site”, with reference to the processing of personal data of Users consulting it.

This information is provided pursuant to Regulation 2016/679/EU (General Data Protection Regulation – hereinafter GDPR) and the Personal Data Protection Code (Legislative Decree 196/03, the so-called Privacy Code). The information is provided only for the Site and not for other websites that may be consulted by the User via links.

Users must read this Privacy Policy carefully before submitting any personal information and/or filling in any electronic form on the Site.

For the use of specific services by Users, specific information will be provided from time to time and specific consents to the processing of their personal data will be requested, where necessary.

Place of data processing

The processing operations connected to the web services of this Web Site take place at the above-mentioned premises of Tfs Tecno Fluid Service s.r.l. and are carried out by personnel authorised to the processing and by technical personnel of the Office in charge of processing, or by persons in charge of occasional maintenance operations.

Personal data are processed with electronic or automated instruments.

No data deriving from the web service is communicated or disseminated.

The personal data provided by Users who request the return of informative material (newsletters, answers to queries, etc.) are used for the sole purpose of performing the service or provision requested and are communicated to third parties only if necessary for that purpose.

Type of data processed and purpose of processing

Browsing data

The computer systems and software procedures used to operate these sites acquire, during normal operation, some personal data that are then implicitly transmitted when using Internet communication protocols.

This information is not collected in order to be associated with identified interested parties, but by its very nature could, through association and processing with data held by third parties, allow Users to be identified, following an explicit request by the Judicial Authority.

This category of data includes the IP address, the domain names of the computers used by Users who connect to the Site, the URI (Uniform Resource Identifier) notation addresses of the requested responses, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the User’s operating system and computer environment.

Data provided voluntarily by Users/visitors

The User can surf the Site without revealing to Tfs Tecno Fluid Service s.r.l. his personal identity. However, if the User chooses to provide his personal data, he consents to the collection and use of the same as described in the Privacy Policy.
If the User, connecting to this Site, should send – in an optional, explicit and voluntary way – his own personal data in order to access certain services, or to make requests by e-mail, this will involve the acquisition by Tfs Tecno Fluid Service s.r.l. of the sender’s address and/or other possible personal data that will be processed exclusively to answer the request, or to supply the service.

Option of providing data

With the exception of what is indicated in relation to navigation data, the User is free to provide the personal data requested from time to time by Tfs Tecno Fluid Service s.r.l.. However, failure to provide such data may make it impossible to supply the services requested.

Marketing

Tfs Tecno Fluid Service s.r.l. does not sell, nor does it cede for compensation, the User’s personal data collected during navigation on the Site to third parties for marketing purposes, without the explicit consent of the User concerned. Tfs Tecno Fluid Service s.r.l. can associate the User’s data to information that will be collected by other companies in order to improve and personalize the services offered and the contents of the Web sites.

Purposes and duration of the treatment

Tfs Tecno Fluid Service s.r.l., through the Site provides for the collection of personal data spontaneously provided by the User, in order to offer a safe, easy, efficient and personalized service to the User.

In this sense the User authorises Tfs Tecno Fluid Service s.r.l. to use the personal data for the following purposes:

to manage the candidature referred to in the curriculum vitae sent
to provide the profile of the User, in relation to the electronic communication services provided
provide services and customer support at your request
resolve disputes and settle problems
prevent potentially prohibited or unlawful activities and enforce the provisions of the User Agreement;
customise, measure and improve the services offered and the content of the websites;
provide information on the services offered and those of other companies, sending notices on updates to services and promotional offers;
compare the accuracy of data and verify them with third parties;
for the management of the contractual relationship (by way of example, for the invoicing of fees, for the management of payments or any claims submitted) and for the provision of the services requested.
The data provided will be processed only for the time necessary for the above-mentioned purposes and will be kept for a maximum of six months, without prejudice to further storage for any investigation of computer crimes to the detriment of the Site or to respond to specific regulatory obligations.
The data provided with the curriculum vitae are kept for twelve months in order to follow up the selection process.

Disclosure of personal data

The User acknowledges and accepts that Tfs Tecno Fluid Service s.r.l. has the faculty to disclose personal data upon request of the Judicial Authority, within the limits prescribed by the law, as well as in cases of violation of the Privacy Rules, of civil and criminal proceedings, also for violation of the rights of third parties, in order to protect the rights, the property or the safety of each User.

Method of processing

Processing is carried out using automated tools (e.g. using electronic procedures and media) and/or manually (e.g. on paper) for the time strictly necessary to achieve the purposes for which the data were collected and, in any case, in accordance with the relevant regulations in force.

Rights of data subjects

The Users to whom the personal data refer have the right at any time to access and exercise the other rights concerning the data: for example, to request the origin of the data, rectification of inaccurate or incomplete data, restriction of processing, cancellation or oblivion, portability of the data, as well as to oppose their use for legitimate reasons by contacting Customer Care or sending an email to a.amodio@tfs.it

In addition, pursuant to the regulations in force, you may lodge any complaints regarding the processing of your personal data with the Garante per la protezione dei dati personali.

Third parties

With the exception of the cases expressly indicated in the Privacy Policy, this document refers exclusively to the use and disclosure of data provided directly by the User. If personal data are communicated to others on other Internet sites, the use and disclosure of the communicated data may be subject to other rules. Tfs Tecno Fluid Service s.r.l. does not control the privacy policies of third parties and the User is subject to the privacy policies of such third parties if applicable. We encourage the User to obtain relevant information before disclosing personal data to others.

Tfs Tecno Fluid Service s.r.l. may change the content of these Privacy Rules at any time by posting the new version on its Site. All new terms and conditions will be effective 30 (thirty) days from the date of publication. Customer information on the processing of personal data

Tfs Tecno Fluid Service s.r.l. hereby informs you that your personal data will be processed in compliance with Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and with Legislative Decree no. 196/2003 bearing the “Privacy Code”.

Data source. The aforesaid data may be either (i) voluntarily provided by the CUSTOMER for the conclusion of the CONTRACT, (e.g. for technical assistance, request of offers, complaints, etc.) and/or during the contacts with the employees, representatives, salesmen, telephone operators of Tfs Tecno Fluid Service s.r.l. in charge of the activities related to the conclusion of the CONTRACT or, in any case, during the CONTRACT signature phase by any other means either (ii) collected and processed by Tfs Tecno Fluid Service s.r.l. in order to execute the CONTRACT and its related obligations.
Addressees. This Information Notice applies to: – Residential Customers and SMEs – Potential Customers (in the process of contracting or expressing interest in the service). In the following text, the subjects indicated above are referred to as “interested parties” in the processing of personal data.
Types of data processed. The data being processed are: data allowing direct identification (personal details, contact details, contractual and consumption data); special data (only in cases provided for by law); company name, address, telephone number, POD, e-mail, certified mail, bank and payment references, communicated by you on the occasion of the conclusion of contracts for the Controller’s services and during the period of validity of the contract.
Period of data retention:We inform you that your data will be kept for a period of time not exceeding 10 years from the termination of the contract and/or the last service and/or as required by civil and tax regulations.
Purposes, legal basis for processing:Your personal data will be processed for the purposes and related legal bases indicated below:

Purposes of processing whose legal basis is the execution of the CONTRACT – The data provided by the CUSTOMER will be used for the conclusion and execution of the CONTRACT and the related sales relationship or any other similar matter, and to fulfil the legal obligations arising from the CONTRACT itself. They shall therefore be processed for:

A) Purposes strictly connected to the execution of the contract and to the relative sales relationship or other similar cases: 1) pre- and post-contractual activities preliminary to the conclusion of the contract; 2) activities connected to the possible technical assistance; 3) sale, delivery, installation/uninstallation and management of the products sold by Tfs Tecno Fluid Service s.r.l. and all activities inherent and consequent to this, including the processing necessary for the execution of any pre- and post-sales activities; 4) activities related to the guarantee on the products themselves 5) management of any contractual variations; 6) management of variations related to personal data; 7) management of receipts 8) invoicing, processing, printing, enveloping, shipment of invoices 9) management of any requests for information, interventions, assistance, complaints, disputes; 10) protection and possible recovery of credit, including checks on the solvency of the CUSTOMER; 11) verification of the degree of satisfaction of the quality of the product/service provided directly or possibly through specialised companies, by means of interviews or other means of detection. The provision of personal data for such purposes is compulsory and implicit in the conclusion of the contract/pre-contractual activities, and any failure to provide such data shall jeopardise the supply of the products/services requested. The acquisition of consent to the processing of Personal Data is not in fact necessary for all processing connected with and/or indispensable for the performance of obligations deriving from a contract to which the data subject is a party or in order to fulfil, prior to the conclusion of the contract, specific requests of the data subject.

Processing purposes whose legal basis is the legitimate interest of the Controller

B) analysis and statistical models: 1) analysis aimed at producing studies, statistical and market research; 2) reporting and analysis, carried out directly by Tfs Tecno Fluid Service s.r.l. or by third party companies delegated by the same for the purpose of providing you with information, reports and statistics inherent to the product purchased by you and its use; 3) analysis for price renewals on expiry The conferment of personal data for this purpose is compulsory and is carried out on the basis of a balancing of the interests and rights of the data subject and of the Data Controller: failure to confer such data may jeopardise the supply of the products/services requested. Period of data retention: We inform you that your data will be kept for 10 years from the termination of the contract or as provided for by civil and tax regulations.

Processing purposes whose legal basis is the consent of the data subject

– Subject to the CUSTOMER’s specific consent, the CUSTOMER’s data may be used, both by telematic means (such as sms, instant messaging, email, etc.) and by traditional means (such as mail, telephone, fax and/or attachment to invoice), for the following purposes

C) Promotional, commercial and marketing purposes, unless consent is withdrawn: 1) sending/communication by Tfs Tecno Fluid Service s.r.l. of advertising, informative, promotional material about new products/services of Tfs Tecno Fluid Service s.r.l. itself and/or of other companies controlled by/controlling and/or connected to Tfs Tecno Fluid Service s.r.l, as well as any third party companies; 2) direct sale and/or placement by Tfs Tecno Fluid Service s.r.l. of products/services, facilities and promotions of Tfs Tecno Fluid Service s.r.l. itself and/or other subsidiaries/controlling and/or affiliated companies of Tfs Tecno Fluid Service s.r.l. as well as of possible third party companies, through different sales channels or appointed third party companies.
D) Purposes of Profiling, unless consent is revoked: 1) Study and analysis of consumption habits and patterns in order to improve the commercial offer and make specific promotions of products and/or services, through marketing specifically related to such studies and analysis.

Consent for the analysis of habits allows the processing of data solely for the purpose of creating case studies, behavioural models and analysis of your consumption habits and preferences for the sole internal use of Tfs Tecno Fluid Service s.r.l. and its subsidiaries/controlling companies. The consent to the processing of personal data for the purposes of point 4 letters C), D) is optional and any refusal will not prejudice the supply of the products/services requested. The CUSTOMER may in any case object to such processing at any time by making a simple request to Tfs Tecno Fluid Service s.r.l.. Period of data retention: The data referred to in B), C) will be retained for a period of time not exceeding 12 months from the end of the contractual relationship, without prejudice to the request for periodic confirmations regarding the status of the consents given by you during the period of effectiveness of the contract. For the same period of time, your data collected and processed for the purpose referred to in point C) above will be kept.

Obligatory nature of the data and Modalities of Processing. The communication and updating of your data is compulsory for the fulfilment of the obligations provided for by the laws in force and for the execution of the obligations deriving from the contract to which you are a party; failure to fulfil this obligation would make it impossible for Tfs Tecno Fluid Service s.r.l. to meet your requests and to execute the contract. In relation to the above-mentioned purposes, data processing will be carried out by means of computerised tools and, in any case, by means of instruments suitable to guarantee confidentiality, integrity and availability through the adoption of adequate security measures, as prescribed by the Regulation.
Categories of data recipients. The data of the CUSTOMER may be known (i) by the employees and collaborators of Tfs Tecno Fluid Service s.r.l. by reason of the business function carried out, who operate as subjects authorised by the Holder and duly instructed by him/her; (ii) by the employees and collaborators of companies controlled by/connected to Tfs Tecno Fluid Service s.r.l, (iii) by third parties (suppliers of technical, technological, mailing services, banking and credit institutions and suppliers of services instrumental to the supply of services/products object of the CONTRACT; call centres, marketing companies and advertising and market research services for the activities subject to the consent of the concerned party) duly appointed as Persons in charge of the treatment by Tfs Tecno Fluid Service s.r.l.. The data will mainly be processed in Italy and in states belonging to the European Union, guaranteeing in any case the necessary standards of protection and safeguard required by national and supranational regulations, such as the adoption of Standard Contractual Clauses approved by the European Commission. Dissemination of data. The personal data of the Data Subject without his/her specific authorisation will not be disseminated in any way outside the company perimeter and/or published on the company website.
